Terms of Service
These terms are a legal agreement between you and Loomee Group (Pty) Ltd, trading as Qcandidate, and govern your use of Qcandidate, a web-based AI CV screening and hiring platform sold as a monthly subscription.

1. Who we are
Qcandidate is owned and operated by Loomee Group (Pty) Ltd, a private company registered in the Republic of South Africa, trading as "Qcandidate" ("Loomee Group (Pty) Ltd", "we", "us"). Contact: p.sweleni@loomeeremote.com. In these Terms, "Qcandidate" means the service provided by Loomee Group (Pty) Ltd.
2. The service
Qcandidate provides software for posting roles, collecting applications, scoring CVs against an explainable rubric, generating audit artifacts, and sending upskilling ("Growth Kit") recommendations to candidates. Access is delivered instantly online after payment; nothing is shipped physically.
3. Accounts
You must provide accurate details, keep credentials secure, and are responsible for all activity under your account. Accounts are for business use by the organisation that subscribes.
4. Subscriptions and billing
Plans are billed monthly in US dollars through Lemon Squeezy, the authorised reseller and merchant of record for Loomee Group (Pty) Ltd. Lemon Squeezy handles the transaction, invoices and applicable taxes. Plans renew automatically each month until cancelled. Usage above your plan's CV allowance is blocked rather than charged.
5. Cancellation
You may cancel at any time from your account or by emailing us. Cancellation stops future renewals; access continues to the end of the paid period. See our Refund Policy for refund terms.
6. Acceptable use
You may not use Qcandidate to unlawfully discriminate, to process data you have no lawful basis to process, to reverse engineer the service, to resell it without written permission, or to upload malicious content.
7. AI outputs and human oversight
Scores, rankings and Growth Kit suggestions are decision support, not decisions. You agree to apply human review before rejecting or hiring anyone, and you remain the employer and the data controller for your hiring decisions and their compliance with laws such as the EU AI Act, GDPR, NYC Local Law 144 and EEOC guidance.
8. Intellectual property
Loomee Group (Pty) Ltd retains all rights in the platform. You retain all rights in your job specs, rubrics and candidate data. You grant us a limited licence to process that content solely to provide the service.
9. Availability and liability
The service is provided "as is" without warranty of uninterrupted availability. To the maximum extent permitted by law, the aggregate liability of Loomee Group (Pty) Ltd is limited to the fees you paid in the twelve months before the claim. We are not liable for indirect or consequential loss.
10. Suspension and termination
We may suspend or terminate access for non-payment or breach of these terms, with notice where reasonably practicable.
11. Changes
We may update these terms; material changes will be announced in-app or by email before they take effect.
12. Governing law
These terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction, without limiting any mandatory consumer rights in your country of residence.
